PvP confusion

The knowlege base has nothing clarifying this to my satisfaction:

As an alliance character on PvP server with PvP disabled

I can attack Horde character in Alliance Territory
I can attack Horde character in Contested Territory
I CANNOT attack Horde character in Horde Territory but can retaliate if attacked then it's open season on that character.

this much i have ascertained from my own experiences.

However from my own experience i have also ascertained that:

Horde can attack me: In ALL TERRITORIES which is the bit i do not understand. I had previously understood the dynamics were that in home territories, opposing factions could not INITIATE hostilities so if you did not bother them they couldn not bother you.
I'm being attacked in home territories like westfall and elwynn forest on regular basis without instigating hostilities and without enabling PvP and can't quite work out why?
Is it a collective hostility thing? if i am part of a party that has decided to open hostilities does that tar me with same brush and make me fair game? Does that extend to Guild actions? (In which case we are all fucked cos Bider and Qp are so notorious they even made the official forums with their skullduggery)

I'm just finding the rules of this game very 'fluid' and never quite flowing in my favour.

i do prefer the former but there is no sense in being killed senselessly by an opponent i cannot put so much as a tarnish of the armour of.
Spoke with Stroph on MSN about this and we are both scratching our heads as to why i can get attacked unprovoked on alliance territory.
I had previously used my 'discretion the better part of valour' tactic to track enemies without them being able to do owt about it but if this is no longer going to be possible i'm gonna have to roll the old sleeves up and start slapping horde.

that's the magic thing:
when u pass from a Contested Territory, or Horde Territory to an Alliance territory you will still be marked as "PvP player" for five minutes, after five minutes you will be marked a "Non PvP player". If attack some horde player in the alliance territory the timer resets. If you are attacked in the alliance territory while still marked PvP but u do not answare the attack, the timer do not reset.

oh another thing: when u duel, u are marked as PvP this is my strategy to kill high lvls in a Horde territory. I'll explain. Go ouside orgrimmar and stealth (if i can't stealth, reroll rogue or druid). There are always some lvl 70 dueling; w8 until one of them is 1% health and then dash, sprint (or use swiftness potion) and use your favourite opener to kill him then kill the other one. I'm such a genius ^_^
